Terms of Service
Version 2026-10-06 · Last updated May 21, 2026
1. Acceptance of these Terms
These Terms of Service ("Terms") govern your access to and use of the Heliovue platform, including the web application, APIs, and related services (collectively, the "Service"), provided by 4Tech LLC ("Heliovue", "we", "us", or "our").
By creating an account, accepting these Terms during onboarding, or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
2. The Service
Heliovue provides software for processing drone-captured imagery of solar installations, including radiometric thermal calibration, orthomosaic generation, automated anomaly detection, and report generation. The Service is provided for informational and inspection-support purposes.
We may add, change, or remove features at any time. We may also offer different service tiers (for example, "basic" and "premium"), with certain features limited to specific tiers.
3. Accounts and eligibility
You must provide accurate account information and keep it current. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use.
You must be at least 18 years old and capable of forming a binding contract to use the Service.
4. Organizations and team access
The Service allows you to create or join an organization and to invite other users. Organization owners and members may be able to view and act on data within the organization, including farms, captures, inspections, and reports. You are responsible for managing your organization membership and for the actions of your members.
5. Your content and data
You retain all ownership of the imagery, flight data, and other materials you upload ("Customer Data"), and of the processing outputs generated from it (such as orthomosaics, anomaly catalogs, and reports). You grant us a non-exclusive, worldwide license to host, process, transmit, and display Customer Data solely to provide and improve the Service for you.
You represent that you have all rights necessary to upload Customer Data and to grant this license, and that your capture and use of the imagery complies with applicable laws, including aviation, drone-operation, privacy, and property-access laws.
6. Acceptable use
You agree not to: (a) use the Service unlawfully or in violation of any applicable regulation, including civil-aviation and drone rules; (b) upload content you do not have the right to use; (c) attempt to gain unauthorized access to the Service or other users’ data; (d) reverse engineer, decompile, or attempt to extract the source code or trained models of the Service, except as permitted by law; (e) interfere with or disrupt the integrity or performance of the Service; or (f) resell or sublicense the Service without our written consent.
7. Plans, fees, and changes
Some features require a paid plan. Applicable fees, billing terms, and tier entitlements will be presented to you before purchase. Unless stated otherwise, fees are non-refundable. We may change pricing and plan features on a prospective basis with reasonable notice.
8. Intellectual property
The Service, including its software, user interface, documentation, and trained detection models, and all related intellectual property, is and remains the property of Heliovue and its licensors. These Terms do not grant you any rights in the Service except the limited right to use it as described here.
9. Third-party services
The Service runs on third-party infrastructure, including Google Cloud Platform and Firebase. Your use of the Service may be subject to those providers’ terms. We are not responsible for third-party services we do not control.
10. Inspection disclaimer
The Service’s thermal calibration, anomaly detection, and reports are automated, advisory tools that may contain errors or omissions. They are not a substitute for inspection, testing, or judgment by a qualified professional, and must not be relied upon as the sole basis for electrical-safety, maintenance, warranty, or operational decisions. You are solely responsible for verifying findings and for any decisions you make.
11. Disclaimers of warranties
The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be accurate or complete.
12. Limitation of liability
To the maximum extent permitted by law, Heliovue will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amounts you paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred US dollars (USD 100) if you have paid nothing.
13. Indemnification
You agree to indemnify and hold harmless Heliovue from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your Customer Data, your use of the Service, or your violation of these Terms or applicable law.
14. Term and termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the version and may require you to re-accept the Terms before continuing to use the Service. Your continued use after an update constitutes acceptance of the revised Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Tennessee will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to their jurisdiction and venue.
